California’s Regulatory Success in Curbing Intoxicating Hemp Sales
In a significant regulatory achievement, California Governor Gavin Newsom recently reported that businesses across the state are adhering nearly universally to the ban on intoxicating hemp products. This compliance stems from emergency regulations enacted in September 2024, aimed at safeguarding consumers, particularly youth, from THC effects by prohibiting any intoxicating cannabinoids in hemp products. Additionally, these regulations established a minimum purchase age of 21 for hemp products.
The stringent measures have faced legal challenges, including a lawsuit filed by various industry stakeholders. Despite these challenges, a temporary restraining order was denied, reinforcing the state’s firm stance on public safety. Governor Newsom emphasized the importance of protecting vulnerable populations by keeping such products away from them.

California’s position as a trailblazer in cannabis reform is well-documented. As the first state to legalize medical cannabis in 1996 and subsequently recreational use in 2016, California has consistently led progressive cannabis legislation. However, recent trends in hemp production, where THC is included without adhering to cannabis safety protocols, prompted decisive action via the new regulations.
These measures are concurrently overseen by multiple state agencies, including the Department of Alcoholic Beverage Control (ABC), California Department of Public Health, and the Department of Cannabis Control, among others. State and local law enforcement are also integral to the enforcement process, highlighting a comprehensive effort to ensure compliance.

According to the ABC, an impressive 99.7% of businesses were found to be in compliance with the updated regulations in 2025, a notable increase from 97% reported in November 2024. Non-compliance can lead to significant penalties, including criminal charges and license revocation. ABC Chief Deputy Director Frank Robles noted that agents have been effective in removing non-compliant products during inspections.
A detailed enforcement log is maintained by ABC, recording weekly activities. For example, in the week ending May 4, ABC agents inspected 218 locations, identifying two violations and seizing 57 products. This proactive approach reinforces the message that California remains committed to ensuring the safety and integrity of its cannabis and hemp markets.
